    1. Acceptance of Terms

    By accessing and using CryptoITR.com ("the Platform"), operated by KCS Creations ("we", "our", or "us"), you agree to be bound by these Terms of Service, our Privacy Policy, and our Disclaimer. If you do not agree to these terms, please do not use our services.

    2. Description of Services

    CryptoITR.com is a cryptocurrency tax calculation tool designed for Indian residents. Our services include:

    • Crypto tax calculation for spot and futures trading based on uploaded trade data (CSV/XLSX files) from supported exchanges
    • Tax report and summary generation
    • Educational blog content related to crypto taxation in India

    Important: CryptoITR.com is a software tool, not a Chartered Accountant (CA) firm, tax advisory service, or financial advisor. We do not provide tax advice, legal advice, or financial planning services. All calculations are for informational purposes only. Please consult a qualified tax professional before filing your Income Tax Return.

    3. User Eligibility

    Our services are available only to:

    • Residents of India
    • Individuals who are at least 18 years of age
    • Users who consent to our Privacy Policy, Disclaimer, and these Terms

    4. Pricing and Payments

    CryptoITR.com offers the following pricing tiers:

    • Free -- 2 tax calculations at no cost
    • Starter -- ₹199 per Financial Year (FY) for 4 tax calculations (up to 400 transactions)
    • Pro -- ₹499 per Financial Year (FY) for 50 tax calculations with unlimited transactions
    • CA Professional -- ₹1,999 per Financial Year (FY) for unlimited calculations and multi-client management

    All prices are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST). Payments are processed securely through Razorpay. We do not store your payment details on our servers.

    Any attempt to circumvent or manipulate calculation limits is a violation of these terms.

    5. User Responsibilities

    You agree to:

    • Provide accurate and complete trade data; we are not liable for incorrect tax calculations resulting from inaccurate, incomplete, or improperly formatted data uploaded by you
    • Maintain the confidentiality of your account credentials
    • Use the Platform only for lawful purposes
    • Not attempt to circumvent security measures, calculation limits, or access restrictions
    • Not upload malicious files, viruses, or harmful code
    • Not reverse-engineer, decompile, or attempt to extract the source code of the Platform

    6. Limitation of Liability

    CryptoITR.com provides tax calculation tools for informational purposes only. To the maximum extent permitted by law, KCS Creations and its directors, employees, and affiliates shall not be responsible or liable for:

    • Accuracy of calculations based on user-provided data -- if you upload wrong data, the resulting tax calculation will be wrong
    • Tax filing outcomes, penalties, interest, or legal consequences
    • Any decisions made or actions taken based on our calculations or content
    • Any indirect, incidental, consequential, or punitive damages arising from the use of the Platform

    Our total liability in any case shall not exceed the amount paid by you for the specific service giving rise to the claim.

    7. Intellectual Property

    All content on CryptoITR.com, including but not limited to text, graphics, logos, UI design, software code, algorithms, and documentation, is the intellectual property of KCS Creations and is protected by applicable Indian intellectual property laws. Users may not copy, modify, distribute, reproduce, or create derivative works from our content without prior written permission.

    Your uploaded trade data remains your property. By uploading it, you grant us a limited licence to process it solely for the purpose of providing tax calculation services to you.

    8. Account Termination

    We reserve the right to suspend or terminate your account, without prior notice, if:

    • You violate any of these Terms of Service
    • You engage in fraudulent, abusive, or illegal activity on the Platform
    • You attempt to circumvent calculation limits or payment requirements
    • Required by law or regulatory order

    You may delete your account at any time. Upon termination, your access to the Platform will cease, though data may be retained as per our Privacy Policy and legal obligations.

    9. Force Majeure

    KCS Creations shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, epidemics, government actions, internet or infrastructure outages, cyberattacks, changes in law or regulation, or acts of third-party service providers.

    10. Indemnification

    You agree to indemnify and hold harmless KCS Creations, its directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these terms, or infringement of any third-party rights.

    11. Changes to Terms

    We may modify these terms at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised terms. If you do not agree with the updated terms, you should stop using the Platform.

    12. Governing Law and Dispute Resolution

    These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts at Noida, Uttar Pradesh, India. The parties shall attempt to resolve any disputes amicably before resorting to litigation.

    13. Severability

    If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
